Our yearbook class is using "children's literature" as the theme for this year's edition of the yearbook. For the cover they have a photograph of a heap of children's books. (Pat the Bunny, Curious George, Good-night, Moon, etc.) Most of thecovers are partially covered by other books; a few of them are shown completely however. So here's my question. Is it a violation of copyright to use these book covers in this way? On the surface the answer seems to be yes, and I've told the sponsor this much. But he wants to know does it make any difference if only part of the book is showing? What if the students reduced resolution so the covers are pretty fuzzy? (This montage of books is going to appear in the background behind the lettering on the cover.) Related questions: Does anyone have experience contacting illustrators about copying images? Did you go through the publishing company or directly to the illustrator? I know one of the questions of fair use deals with profit. While our yearbooks are sold, the class never even breaks even. I appreciate any insights anyone may have and will post a hit.
