Genevieve- (Standard "I am not a lawyer" disclaimer) My answer would be to examine the transformative nature of the work. A oral reading is transitory. It cannot be reproduced or carried about. Creating a recording is more permanent and can be reproduced and duplicated. (And probably will be) Any time a work is transitioned into a new style--there are copyright questions that should be asked carefully. (Just Ask Shepard Fairey!) However! If the book is public domain (Twain, Shakespeare, Verne?) I'd say "go for it." You might want to check, too--if a students 504 plan calls for the book to be read to them, that can specifically mean "read to them" and not "provided with audiobook." (Finally, have you checked if the book is available as audio? $20-40 is not too much to ask for clear consciences.) Harry Harry F. A teacher wants to create their own recordings of books to be used only as a read-along with the print book that they own. These are books for which no recording is available commercially. They will be used by ELL students and the book and recording will always be used together. Can they do this? I said no, but they asked what the difference between that and a read-aloud was.
