Dear LM_Netters: Below is our AUP which I've finally figured out how to post. We expect to make some changes in the fall and I'd be delighted to have input from you. NuevaNet Acceptable Use Policy and Contract NuevaNet MISSION STATEMENT NuevaNet is service provided by and in consonance with the dual mission of The Nueva School: Mission I: To enhance innovative education for gifted and talented children through access to unique resources and collaborations; Mission II: To improve learning and teaching through research, teacher training, collaboration and dissemination of successful educational practices, methods, and materials. NuevaNet is connected to the Bay Area Regional Research Network (BARRNet) which in turn connects it to the Internet. The Internet links computer networks around the world, giving NuevaNet access to a wide variety of computer and information resources. In general, electronic traffic passes freely in a trusting atmosphere with a minimum of constraints. NuevaNet provides open access to these local, national and international sources of information and collaboration vital to intellectual inquiry in a democracy. In defining the Internet's resources as an extension of the Library, this network subscribes to the Library Bill of Rights which states that "A person's right to use a library should not be denied or abridged because of origin, age, background or views." In return every NuevaNet user has the responsibility to respect and protect the rights of every user in our community and on the Internet. NuevaNet account holders are expected to act in a responsible, ethical and legal manner, in accordance with the Nueva Code of Conduct, the missions and purposes of the other networks they use on the Internet and the laws of the states and the United States. NuevaNet ACCOUNT HOLDERS A NuevaNet account is a privilege offered each academic year to the following: 1. All students at Nueva, prekindergarten through grade eight, and their parent(s) or guardian(s). 2. All educators who are working with Nueva students, including classroom teachers, support personnel, administrators, tutors, music staff, specialists and mentors. 3. Educators and students from other educational institutions who are working in partnership with The Nueva School for specific purposes over a limited period of time. NuevaNet CODE OF CONDUCT NUEVA's Code of Conduct applies to all users of NuevaNet. It reads: "I will strive to act in all situations with honesty, integrity and respect for the rights of others and to help others to behave in a similar fashion. I will make a conscious effort to be of service to others and to the community. I agree to follow Nueva's basic rules: no killer statements, no damage to property, and no violence." The NuevaNet account holder is held responsible for his/her actions and activity within his/her account. Unacceptable uses of the network will result in the suspension or revoking of these privileges. Some examples of such unacceptable use are: 1. Using the network for any illegal activity, including violation of copyright or other contracts; 2. Using the network for financial or commercial gain; 3. Degrading or disrupting equipment or system performance; 4. Vandalizing the data of another user; 5. Wastefully using finite resources; 6. Gaining unauthorized access to resources or entities; 7. Invading the privacy of individuals; 8. Using an account owned by another user; 9. Posting personal communications without the author's consent; 8. Posting anonymous messages. NuevaNet CONSENT AND WAIVER By signing the Consent and Waiver form attached, the requestor and his/her parent(s) or guardian(s) (if the requestor is a student) agree to abide by these restrictions. The student and his/her parent(s) or guardian(s) should discuss these rights and responsibilities together. Further, the requestor and his/her parent(s) or guardian(s) are warned that The Nueva School does not have control of the information on the Internet, nor does it provide any barriers to account holders accessing the full range of information available other than those constraints imposed by finite resources. Other sites accessible via the Internet may contain material that is illegal, defamatory, inaccurate or potentially offensive to some people. While NuevaNet's intent is to make Internet access available to further its educational goals and objectives, account holders will have the ability to access other materials as well. Nueva believes that the benefits to educators and students from access to the Internet, in the form of information resources and opportunities for collaboration, far exceed any disadvantages of access. But ultimately, parent(s) and guardian(s) of minors are responsible for setting and conveying the standards that their child or ward should follow. To that end, Nueva supports and respects each family's right to decide whether or not to apply for NuevaNet access. The account holder and, if a minor, his/her parent(s) or guardian(s) must understand that NuevaNet is an experimental system being developed to support Nueva's educational responsibilities and missions. The specific conditions and services being offered will change from time to time. In addition, an account holder uses NuevaNet at his/her own risk. Nueva makes no warranties with respect to NuevaNet service, and it specifically assumes no responsibilities for: 1. The content of any advice or information received by an account holder from a source outside Nueva, or any costs or charges incurred as a result of seeing or accepting such advice; 2. Any costs, liability or damages caused by the way the account holder chooses to use his/her NuevaNet access; 3. Any consequences of service interruptions or changes, even if these disruptions arise from circumstances under the control of Nueva; 4. While NuevaNet supports the privacy of electronic mail, account users must assume that this cannot be guaranteed.
