Many of you have requested a hit on what I have found out about overdue
fines for public schools. I am in Minnesota, and Statute 123b.37 is the
cite that addresses fines. It states that school libraries may fine for
lost and/or damaged materials but does not say anything about overdue fines.
The Reference Librarian who has so graciously been looking for me thinks the
law may need further clarification and needs to be read by an attorney for
complete understanding. I am still inclined to believe that it is illegal
for Minnesota schools to assess fines for overdue materials. Of course, I
have been proven wrong many times! It appears that this may be a local
issue - either state or district. Good luck to those of you who may need to
research further for your own district. I will post again when I get a
confirmed answer from the state. I went to our state Education (Center for
Children, Families and Learning) cite to pursue this answer. Good luck!
