Michelle, The information I received via school from an attorney... the practie of students grading each others papers violates the Family Educational Rights and Privacy Act (FERPA) because the grade on an individual assignment is an "educaiton record". This decision came from The Tenth Circuit Court of Appeals. The appellate court overturned a lower court decision to the contrary, and rejected the United States Department of Education's opinion, issued in a letter several years ago, that said the practice was not a violation of the law because the individual grades weren't "education records" due to the fact that the papers werern't "maintained" by the schoo. The judges said that doesn't matter because the GRADES on them are "maintained" by the teachers in their grade books. Therefore the schore and the grade are confidential and protected by FERPA.
