Hello Group,

  I stumbled across at least three sellers who I think are downloading
images from the Library of Congress American Memory Website and selling
them as packaged collections on CDs (North American Indians, Civil War
Maps, Railroad Maps, Edison Motion Pictures on Fire Fighting, etc.). While
much of the material is no longer copyrighted, where does attribution begin
and end. The one that stood out the most was the Edward S. Curtis
collection of North American Indians. These were billed as Over 2200
Antique American Indian Photogravure Images on a Single CD. When I wrote
the seller about attribution he stated that he had attributed the
photographs to Edward S. Curtis. However, when you look at the copyright
and other restrictions notice on the Library of Congress page, it clearly
states that Northwestern University Library claims copyright of the images
and they can be used for education or research purposes with the condition
that attribution be given to Northwestern University Library. It doesn't
clearly state that permission is needed for other purposes.
    I know of no other source where you can obtain 2200 high resolution
images other than at the American Memory Web site. So where where does
copyright end, public domain begin? Do these sellers need to provide
attribution to where they retrieved the photographs or just the individual
who created the material?
    With so many items being digitized it would be easy to create lots of
different CDs and sell them on eBay. It's a real money maker with a range
in price from $9.95 - $19.95 and a lisiting of 100 for sale at a time.

Photographic Images
The following statement is made by Northwestern University Library, the
owner of the original materials reproduced here.
The North American Indian was published and copyrighted between 1907-1930.
Northwestern University Library is not aware of any current U.S. copyright
or other restrictions on the use of the publication, claiming only physical
ownership of a copy of the publication. Northwestern University Library
claims copyright in the images produced for this digital collection. Each
author holds copyright of his essay. The contents of this digital
collection are provided for use in research, teaching, and private study.
For these purposes, you may reproduce (print, make photocopies, or
download) materials without prior permission, on the condition that you
provide proper attribution of the source in all copies (see below).
Northwestern University Library does not provide any type of reproductions
for the images. For the convenience of users a list of Sources for
Reproductions has been identified.
