As I mentioned before, several states do not allow teachers to collect SS benefits on the spouse or on benefits the teacher might have earned in jobs which withheld SS funding. It appears that the "loophole" which allows us to collect these funds will be eliminated. (I think it most unfair that I won't collect on what I earned in 18 years in the business world.) It is time to write letters to Congress. See information below. +++++++++++++++++++++++++++++++++++++ SOCIAL SECURITY "LOOPHOLE" ENDANGERED During the week of November 18th, a last-minute proposal was considered in the U. S. Congress that would have effectively eliminated the last-day exemption allowing many Texas school employees to be eligible for spousal Social Security benefits. The proposal came as part of a substitute to a House bill, H.R. 4070. The substitute language provided that an employee subject to the Government Pension Offset (the current law that reduces or eliminates spousal benefits for school employees who do not pay into Social Security) would have to work for the previous 60 months in a position paying into both Social Security and the government pension system (i.e., TRS) in order to be exempt from the offset. This would eliminate the current option that allows employees to work for as little as one day for a school district that pays into both Social Security and TRS. After passing the U.S. Senate unanimously, the bill returned to the House, but was not considered before the House adjourned. The U.S. House and Senate will not reconvene until January 2003. TCTA will continue to monitor this issue and lobby on behalf of our members.
