Here's the scenario:

Every year the 8th grade students at my school read the play based on the
diary of Anne Frank.  After they finish, they take a test over the play.  Ten
questions come from the publisher and are found at the end of the book.  The
teacher has also made up 10 questions on her own from the play and added them
to the other test questions the students are required to take.

Is it a violation of copyright if we take the teacher's ten questions, as
well as the ten questions from the book (play, that is) and create a
teacher-made test in Accelerated Reader?  They are taking the same test
questions in the classroom--half from the publisher and half from the
teacher--we would just be putting them in a different format.
