Hello, everyone.
In our middle school, our 6th and 7th graders read the book Tuck
Everlasting, and we have class sets of this book. As you know, Disney made
a film of this book. I purchased the video, intending for this to be shown
in portion and whole according to fair use guidelines, and not for reward
purposes. It is for direct classroom instruction. The assistant principal
here decided that since it was Disney, then I couldn't allow it to be shown.
We do not have a district or school policy against Disney videos, nothing
at all in writing. She told me to phone Disney and have them fax something
in writing showing that it was acceptable.
Unfortunately, I felt that this was a request made in ignorance of copyright
and fair use laws, so I emailed our media specialist coordinator in the
district. Her reply was that I was correct.
However, this is not satisfactory to the AP, and she gave me a "talking to"
about non-compliance with her request. I tried to explain how fair use
works, but nothing seemed satisfactory to her. She insists that I must call
Disney.
I believe that I am being sent on a goose-chase, just when we are beginning
inventory.
So, LM-Netters, my request to you is that if you know any information that
would help me address this issue with the principal, I would be grateful. I
tried to search the SLJ archives to see if "Carrie on Copyright" had
anything, but no luck there.
I also was unable to find a division or phone # for Disney to even comply
with the request.
Sorry for the lengthy post, I just needed to vent and request help. Thanks!
