LM_NET Archive



We recently experienced something strange.  We purchased a video our
science curriculum coordinator requested entitled "The Mutter Museum,
strange medical mysteries"  from Discovery Store.com.  We received and
processed it, however about a month later we received a letter from them
that said schools did not have the rights to show it.  The video itself
just says "Any commercial use or duplication of this copyright
material...without prior licensing is forbidden..."  The letter the
Discovery Channel Store sent me said "This video or DVD is for personal
home use only.  It went on to say that any classrom meeting or training
session is considered a public performance.  A Discovery.com customer
service rep reiterated the above and said that legally our school did
not have the rights to show it. I then asked the gal why they sent it to
us when they had a purchase order they were working off of as of course
we have it all marked up and cataloged.  After this experience I am
starting to wonder what else is on our shelves that might fit this
description. I guess I am just real ignorant about laws concerning this.
 I did not realize that a school is considered commercial use.  I
realize that one can't show this and then charge money, however I
assumed that things like this could be shown in the classroom to
supplement the curriculum.  There was also no indication on
Discovery.com's catalog website that there were restrictions on this
video.  Any thoughts or info you may want to share will be appreciated.
