The yearbook advisor in my high school and his group want to replicate a 1940s look in their next book. They're wondering if it's permissible for them to photocopy or scan titles, articles, ads, etc. from old 1940s magazines and use them as grayscaled backgrounds to their own text and photos. I've dug and asked on this but can't seem to get past the conjecture of: well, it is being done in an educational setting; but it is a book that is sold; but it's not a "for profit" sale; etc. Anyone out there had any experience with this and, even better, can you point me to a specific source citing what is and is not allowable with this?
