I've quoted our board's policy below.  It basically says that anything created on 
school time or school equipment belongs to the district (which seems fair to me), 
but that stuff created on the employee's time belongs to the employee.  I feel like 
it's pretty fair. . . if you use the district's resources or time to create it, it 
belongs to the district.  The last part, that I underlined, seems to be the 
sticking point for the original questioner.  I would hate feeling that the district 
"owned" anything I created during the time I was employed by them.  If I created it 
on the job, that's one thing--but on my own time, or over the summer!? Yuck. 
 
Materials developed as part of regular employment are equally the properties of the 
school system and the employee. 
 
School-owned equipment, including computers, may be used for developing and writing 
programs that will be used as part of the instructional program or for 
administrative purposes.  The school system shall maintain full use of all 
educational or administrative materials, software, manuals and related materials 
developed by school system employees during which time they are being compensated.  
No other compensation to the school system shall be required.  
 
The director of schools shall ensure that a contractual agreement shall be executed 
between the employee and the Board when requested by the board and/or the employee. 
 
 
Educational materials created by the employee during the employee's leisure hours 
when the employee is not fulfilling contractual duties to the school system are the 
property of the employee.

Subject: QUESTION: Policies on Teachers'/Librarians' Intellectual Property



 Hello All:
Our school board, who we have been constantly at odds with for many years,
is reviewing our policies and procedures. One of the things they insist on
is owning works created by employees (like lesson plans, or books teachers
may be writing?). Anyway, here is how they phrase it (below).

What I'd like to know is what do your policies say about this matter (if
anything)? It is my opinion that we as a staff should fight this.

*Respect the intellectual property of its administrators, students, and
teaching staff and to prevent the unauthorized reproduction or transmittal
of their intellectual property without their permission **except that works
created by employees as part of their employment shall be considered works
for hire and the property of BFUHS unless an alternative agreement has been
made between the BFUHS Board and the employee. *
