Section 108 says: "For purposes of this subsection, a format shall be considered obsolete if the machine or device necessary to render perceptible a work stored in that format is no longer manufactured or is no longer reasonably available in the commercial marketplace."=20 You say that you can find filmstrip players available on e-Bay or other shopping sites. If you wanted to be on the safe side (not that there is a huge risk of getting sued), then you would be inclined to think that filmstrip players are not yet obsolete. On the other hand, what did Congress mean by the "commercial marketplace?" Could it be argued that the commercial marketplace does not include "secondary markets" (e-bay, the neighborhood garage sale, etc). After all, the original manufacturer of the filmstrip players are not making any more money on used filmstrip players sold by others. Are filmstrips still being sold?=20 These are questions to ponder, but perhaps more importantly, you could make a good argument that copying some of the slides of the filmstrip for classroom use is a fair use. =20 -Carrie Russell -----Original Message----- From: Sharron McElmeel [mailto:mcelmeel@mcelmeel.com]=20 Sent: Tuesday, September 30, 2008 10:06 PM To: Carrie Russell Cc: LM_NET@LISTSERV.SYR.EDU Subject: Gen: Copyright - obsolete (filmstrips?) DownEast, 2008. 978-0-89272-725-4 The Dump Man's Treasures is a book for our times, a book to love if you are an environmentalist concerned about waste, a librarian who loves books more than anything else, or a teacher who values the ability to read as a person's most essential skill. Mr. Pottle, the dump man in a small town in Maine, separates trash from treasure when people drop off their dump loads, and he especially has his eye out for books-all books! He cleans them, repairs them, and lends them out from his makeshift lending library at the dump. When they threaten to overrun the place, he even loads them into an old grocery cart and delivers them all over town to those who can't get to the dump. Only when his cart fails him, loses a wheel, and lands his books and him in a ditch with a broken ankle that requires surgery do the people in his town learn his surprising secret. Mr. Pottle, great lover of books, can't read! The children know just what to do; they read aloud to him, and, as the final illustration hints, teach him to read. Illustrated in Owens' characteristic cozy and appealing water color illustrations, this book is a celebration of recycling, books, reading, and community, and one you will not want to miss. Go to the VIEW ribbon and check the ruler box (it is about 1/4 the way down the ribbon.) Once you click it it should stay on. You want to go to the tab "View" then select "Show/Hide." A little box with options shows up and then you "check" the box for "Ruler." You can also change the margins when you go to the Page layout on the menu bar then see margins in the second box. I learned this by pressing F1 and typing "ruler top of page" in the search bar. The first thing that comes up is Hide/show margins. The little box in the righthand corner of your document is what you want to click to view the ruler. -- William L Katzenberger, Jr. Media Specialist Dodge Park Elementary School 3401 Hubbard Road Landover, MD 20785 william.katzenberger@comcast.net -------------------------------------------------------------------- Please note: All LM_NET postings are protected by copyright law.
