HIT (sort of)RE: Gen: a copyright question

First, thank you to all who replied.  I received enough additional
information to back up my
stance on the question.  Several have asked that I post what the responses
were, so here
is a "compiled" version.

All responses indicated that because this was an article in a publication,
classroom fair use guidelines did NOT apply.  The editor should 1) have the
article revised with the poems cited as a souce to refer to, but not
included, 2) obtain permission before using the pieces or 3) not publish
the article, as the inclusion of the pieces would definitely be a violation
of copyright.

The response from the state organization was that the editor should not
publish the article as written because they felt copyright would be
violated.  The result has been that the editor determined who held the
copyright and asked for permission to use the pieces.  The copyright holder
was very quick to grant permission.  The whole process took approximately
15 minutes.

This has been a positive experience for the staff involved, and has again
proven that LM_NET is a community of professionals whose expertise is
extensive.  Again, thank you to all who responded. I am trying to have
staff become accustomed to asking questions about copyright before a
problem occurs and this situation has reinforced this idea.
