Title IX of the Education Amendments of 1972 states that: No person...shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal Financial assistance. Once the amendment was passed into law, the Department of Health, Education and Welfare issued regulations to make the law effective. These regulations are what the local school department must follow in order to comply with the law. The regulations, which went into force on July 21, 1975, covered five specific tasks which were to be taken on the local level: issuance of an official policy statement, naming of a Title IX coordinator,establishing of grievance procedures for students and all employees, completion of a self-study to be completed by July 21, 1976 and held on file for three years and, finally, filing of an "assurance of compliance" form with the Washington office of Civil Rights. I believe that case law has now established sexual harassment complaints to fall under the aegis of Title IX. In fact, there have been many cases filed under Title IX which amplify and clarify the regs. The latest publication that I have in my archives is entitled TITLE IX: APRACTICAL GUIDE TO ACHIEVING SEX EQUITY IN EDUCATION published in November 1988 by the National Coalition for Women and Girls in Education. The regs applying to sports are complicated and well explained in this publication. Hoping this gives your friend a start on dealing with Title IX.
