Privacy isn't the issue here.  Motion pictures may be publicly shown, but
only if one has a license to do so.  This is an intellectual property
issue, and should have been tried as such.  The individuals own the right
to their own images.  The have the right to determine if the use of their
image is in their own interest.  Even movie stars will sue you if you use
their image without permission.  Many movie stars made movies soliciting
war bonds during WWII.  Those films are public domain.  But you can't use
the movie stars' images without permission from the estates of the stars.
