Does your student have a good copyright attorney? What makes your school's attorney believe that the "creative works" of students are not immediately covered under copyright upon creation--even at school? Think about all of those young adult authors who were basically "children" themselves when they wrote their wonderful books -- Amelia Atwater-Rhodes, Christopher Paolini, S. E. Hinton.....none of these students had to wait until they were 21 before copyright law "kicked in"--- and if they (or any other student) creates something--- whether it's at school or home, it's theirs....period. I think your school's attorney is wrong and I hope your school has a major "trust fund" for legal fees if materials are used without the permission of the student and their legal guardians.
