Trademarks can be registered with the Patent and Trademark Office. There is a review process before the PTO officially sanctions the mark. The registrations are first published in PTO's Official Gazette, and then in a searchable database maintained by PTO. However, not all trademarks are registered because it is not a requirement of the law. You can find the database at http://www.uspto.gov/ If you go to this site, you can also find information about how to register a trademark. I have a student who has designed a logo that he wants to have embroidered on team shirts. Someone who saw his design told him that it is already in use, and is copyrighted (trademarked?). How do we find out if "his" design is already protected by copyright? Is there a database to search, and how would you search for a design, anyway? Does he send his design to some government office (address?) and ask to have it trademarked, and let them tell him it's already used? How do I help him? Thanks!
