Although this is a little way from Harry's original question about who takes
IP responsibility for an illegal download, you might like to share the story
of 23 year old Australian James Burt who has been ordered to pay Nintendo
$A1.5 million (that's about $US1.3 million) as well as Nintendo's legal
bills because "made New Super Mario Bros for the Wii gaming console
available for illegal download a week ahead of its official Australian
release in November last year."

From memory, in an interview with his mum, he is just an ordinary bloke who
did it because he could, without thinking, and it is going to take him a
lifetime to pay this. So your students might need to know that there are
really serious consequences and that companies like Nintendo "will pursue
those who attempt to jeopardise our industry by using all means available to
it under the law.''

Another lawsuit that has been in the news is the band Men at Work have been
found guilty of plagiarism, although costs and penalties are yet to be
determined.  It has been decided that the flute riff in "We come from a land
Down Under", an iconic tune here and famous in the US in 1983 when Australia
won the America's Cup, was stolen from the children's tune "Kookaburra sits
in the old gum tree."  Most of us didn't even realise that this had a
copyright owner because it is such a traditional tune sung here!
