You are trying to link those two terms, and that is not the intent. The =
"fair price" part is basically for out of print works. The work is no =
longer produced by the publisher (or the publisher is out of business), =
but an out of print bookseller knows there is a market for this work (for =
example, Madonna's Sex book) and has a few copies. So he puts a price on =
it of 4 or 5 times face value, and actually sells one or two a year at =
that price. That is NOT a "fair price" for the book and you could make a =
copy. IF the purpose of the copy is preservation, the copy can be digital =
- in fact you can make =3D3=3D digital copies. Note, however, that the =
copy (copies)  cannot leave the premises of your library, even via network =
(this is from DMCA) if it is a digital copy.

For obsolete formats, the rule of thumb is that you can't find the =
equipment to play the material on. So consumer Beta format videos are =
obsolete since you can't buy a consumer Beta format player any longer. But =
phonodiscs (records) and filmstrips are still viable formats since the =
equipment to play them is still sold.

I am sure that some of my teachers (and students) will see the "unavailab=

at fair price" and figure that all is ok. =3D


My interpretation of "fair price" is the price that the software sold
originally as opposed to a price widly inflated because the item is no
longer produced.  Thus, unless the item is not available except at an
inflated price then we may not copy - but if someone is reselling an
obsolete item at an inflate price then the copying is ok?

Is this in line with what others think?
