LM_NET Archive



In the fall, I called National Geographic Educational Service to order a
video which I had found on the National Geographic online store site. This
video was called Forces of Nature. The Ed Service claimed that there were
no public performance rights to this video, and therefore they refused to
sell it to us. I asked about the educational "fair use" exemption and they
claimed that it does not apply to items in their online store.
I contacted Eva Levine in their central office by phone on October 24 and
had a long conversation with her about the fair use exemption. She said
she would pass this issue on to the lawyers. I followed up my phone call
with an email to her, with a number of useful sites which explain this
further, including the US code on copyright. I did not hear from her for a
long time, and so followed up with an inquiry email on November 16. She
said it was causing a hot debate in the legal department, and that she
would get back to me. I still have not heard anything.
Has anyone else run into this with National Geographic? Am I correct that
there should be a fair use exemption for any video performance which meets
the educational use guidelines, or have I missed something about the
copyright guidelines?
