Yes, other countries have different laws. The US is a member nation of the World Intellectual Property Organization. Countries that are members have a treaty that they agree to follow in their own country (to a certain extent). The basic rule is a reciprocal agreement - the French author's work will get the US copyright treatment when in US, and the US author 's work will get the French copyright treatment when in France. Your second question is harder and is a key focus of many national and international court cases. I do not believe that it has been resolved in law.
