Booksellers have been leasing books for decades. That is how public = libraries get large stocks of bestsellers for times of peak demand, and = return them when demand dwindles. Furniture has also been leased. Nothing = new there, either. This is a tough economic climate. If a publisher thinks that they can take = advantage of already established federal law to get a little more money in = the till, don't think for a moment that they won't jump at the chance. = There are other revenue streams that copyright owners will be exploiting = in the future. Professor - School of Library & Information Sciences University of North Texas PO Box 311068 205 Chestnut, ISB #205 Denton, TX 76203 940-565-3776 (voice) 940-565-3101 (fax) csimpson@lis.admin.unt.edu >>> Vicki Sherouse <sherouse@MARSWEB.COM> 12/03/02 11:06PM >>> Even though the courts may have upheld the shrink wrap contract with software, I can't imagine them doing so with books of any kind. I think most important legal arguments involve precedent and we have hundreds of years and millions of precedents that books can be loaned and resold. Are they going to shrink wrap chairs and refrigerators, cars? You cannot have laws that are completely unenforceable and the resale of property has to = be seen as a precedent from the stone age!! Frankly, if booksellers want to start leasing books, retailers leasing chairs, etc. and not allow = purchase, I think most people would just close their pocketbooks, which is the most important statement a consumer can make.
